Patents are rights granted to anyone who invents or innovates any new or useful processes, machine. articles of manufacture. composition of matter or any new or useful improvement thereof. Patents can be termed otherwise as statutory privileges granted to the inventor by the Government for a fixed period. In India , the order for grant extends up to a period of twenty (20) years.
Criteria for Patentability in India
To secure a patent, an invention should fulfill the basic characteristics of being

- New – The invention might be a new product or a process which shall not have been used in India and should not have been published anywhere: and

- Non-Obvious The invention (either the product or the process) should possess a relative novelty over the prior art. The said invention should constitute in itself an inventive step. Also, the innovation should posses an industrial application i.e.. it should inculcate the capability of being manufactured or being used in the industry.
